Bill to end 'revenge porn' passes Senate, moves to governor's desk

A bill that would outlaw the sharing of sexually explicit photos for the purpose of humiliating another individual – an act called ‘revenge porn’ – unanimously passed the Senate Thursday. This is Rep. Vincent Buys’ second attempt at passing the legislation.
“Both chambers in the Legislature have taken several votes on my bill this session, and I’m glad we were able to reach agreement on the final language,” said Buys, R-Lynden. “With this legislation, we can finally give victims recourse in addressing this devastating and unacceptable behavior.”
Specifically, House Bill 1272 makes the distribution of intimate images of others, without their consent, a class C felony on the second offense. The bill was also modified for juvenile offenders, saying they cannot be criminally liable if they did not distribute the image intentionally or maliciously.
In January 2014, Seattle Police Department Detective David Blackmer was sentenced to 90 days in jail for posting intimate images of an ex on a phony Facebook account. Since current law does not cover ‘revenge porn,’ he was sentenced according to cyberstalking laws.
Rep. Sharon Wylie's House Bill 2160, which also passed the Senate Thursday, provides a civil liability to ‘revenge porn.’ "I'm thankful for the work and help from Representatives Wylie and Tina Orwall as well as Senator Mike Padden and the advocacy group, Legal Voice. Without their help and support, and that of numerous others, the passage of this great bill would not have been made possible," said Buys.
